Query:

Is stale saliva najis (impure)? How do we differentiate between stale saliva and the drool that trickle from the mouth when we sleep?


I often drool when I sleep, but it seemed clear and colourless in appearance, with a slight smell. At times I wasn’t sure of its colour as it had dried up.


I am not sure whether it was stale saliva coming from the stomach, or from the mouth.


Some scholars said that stale saliva has a bad smell. However, drool that has dried up also has a bad and sour smell. I am confused, Ustaz. I hope so much that you will be able to help.


Response:

According to some religious scholars, stale saliva is not najis (impure), as there is no scriptural evidence (dalil) that specifically states that stale saliva is impure.


Therefore, the simple and more accurate opinion is that there is no issue of najis in your query.


However, the popular ruling among the Shafi’i madhhab (school of thought) held by the Malay community in this region is that stale saliva is considered impure, because of its unclean and foul nature.


If you would like to hold on to this popular Shafi’i madhhab opinion in this matter, please note that stale saliva is defined to be the saliva that flows out of one’s mouth during deep sleep. It has a bad smell and a thick consistency.


If one sleeps just for a short while and the drool that trickles from the mouth does not smell, it may not be considered as stale saliva.


If you are doubtful, revert the matter to its basic ruling, that is:

(1) to consider it as not impure, unless there is a clear evidence, and,

(2) there is no presence of impurity, unless there is evidence of its presence.


Yes, there are some scholars who may have the opinion that, to err in the side of caution, it is better to rule it as impure.


It is up to you to hold on to either opinion – the simple or the conservative.

What is important is not to overburden yourself, up to the point that practising the religion becomes impractical.


Tanya Ustaz Haniff #8: Adakah Air Liur Basi Najis?

Soalan:

Air liur basi: adakah ia najis? Dan bagaimana kita hendak membezakan air liur basi dan air liur yang keluar dari mulut ketika sedang tidur?


Saya sering terkeluar air liur ketika tidur, tetapi warnanya jernih dan agak berbau. Kadang-kadang saya tidak pasti warnanya, kerana sudah kering.


Saya tidak pasti adakah ianya air liur basi yang datang dari perut atau air liur dari mulut.


Ada ustaz mengatakan air liur basi baunya busuk. Tapi, jika air liur yang sudah kering, baunya juga busuk dan masam, Ustaz.


Saya jadi keliru, Ustaz. Harap sangat Ustaz dapat membantu.


Jawapan:

Di sisi sebahagian ulama, air liur basi tidak najis kerana tiada dalil yang dikatakan secara khusus bahawa air liur basi adalah najis.


Maka yang mudah dan lebih tepat ialah tiada timbul soal najis pada apa yang anda tanyakan itu.


Namun, hukum yang popular di sisi mazhab Syafi’i pegangan masyarakat Melayu di rantau ini, air liur basi memang dihukumkan najis sebagaimana yang disebut dalam buku-buku agama yang ada.


Ia dihukumkan najis hanya kerana sifatnya yang kotor dan menjijikkan.

Jika awak masih ingin beramal dengan pendapat popular mazhab Syafi’i dalam hal ini, maka air liur basi ialah air yang keluar dari mulut apabila seorang itu mengalami “deep sleep” atau tidur yang lena. Sifatnya ialah berbau busuk, dan pekat.


Jika seseorang itu tidur hanya sebentar sahaja dan sudah terdapat air liur yang keluar dari mulutnya yang cair dan tidak berbau, ia boleh dianggap bukan air liur basi.


Jika anda ragu-ragu, kembalikan pada hukum asal iaitu asalnya ia bukan najis kecuali ada bukti jelas, dan asalnya tiada najis kecuali ada bukti kewujudannya.


Ya, terdapat sesetengah ustaz mungkin berpendapat bahawa untuk berhati-hati, lebih baik hukumkan air liur basi sebagai najis.


Terserah pada anda untuk menggunakan pendapat yang mana – yang mudah atau yang konservatif.


Yang penting, jangan sampai menyusahkan diri hingga tidak praktikal dalam mengamalkan agama.
